Since the onset of Tenancy Deposit Schemes and the mandatory requirement to have a detailed Inventory, focus has shifted to the quality of the inventory documents and the processes used to ensure these are accurate, fair and unbiased.
As many tenancy deposit scheme cases have highlighted, there is a need for a clear and concise Inventory to protect the Landlord. Without this many landlords have been unsuccessful in pursuing their claim and the deposit has been returned to the tenant in full.
Additionally the processes involved in the preparation of the Inventory, the Check-in and the Check-out are under as much scrutiny as the document itself.
Landlords must bear in mind that the Deposit belongs to the Tenant and in order to lay claim against the deposit the Landlord needs to make a case by presenting evidence of the facts and demonstrate that these are without bias, fair and impartial.
Certainly, with the right knowledge there is no reason why a Landlord couldn't produce a fair and accurate Inventory, however, this process does leave room for the argument of bias and is best avoided. It is deemed best practice for the Inventory to be produced by a third party.
